Terms of Service
Please read these Terms of Service carefully before using the ARKA Digital Media website or engaging our commercial services.
1. Agreement to Terms
These Website Terms of Service govern your access to and use of arkadigitalmedia.com operated by ARKA Digital Media. Specific client retainers, software development builds, and media buying engagements are governed by the executed Statement of Work (SOW) or Master Services Agreement (MSA) signed between ARKA Digital Media and the client.
2. Scope of Services
ARKA Digital Media provides digital marketing strategy, social media marketing, Meta Ads and Google Ads management, search visibility (SEO, AEO, and GEO), website design and development, landing page conversion optimisation, branding and graphic design, photography and videography, influencer marketing, content marketing, analytics reporting, and AI-enabled marketing automation.
3. Commercial Proposals & Payment Terms
Commercial fees, currency denomination (such as AED, USD, or INR), billing schedules, and deliverable milestones are specified in each client's written Statement of Work (SOW). Third-party advertising media budgets (including Meta Ads and Google Ads spend) are billed directly to the client's designated payment method with 0% agency markup unless otherwise agreed in writing.
4. Intellectual Property & Client Ownership
All proprietary frameworks, website content, and brand assets of ARKA Digital Media remain the intellectual property of ARKA Digital Media. Upon full settlement of invoices under an active client Statement of Work, the client owns 100% of custom deliverables, ad accounts, pixel telemetry, and custom website code created specifically for their engagement.
5. Performance Disclaimers & Limitation of Liability
While ARKA Digital Media employs data-driven execution and verified methodologies, commercial outcomes depend on market conditions, competitive dynamics, product-market fit, and client sales follow-up. Past case study results do not guarantee identical future outcomes. To the maximum extent permitted by applicable law, ARKA Digital Media's total liability shall not exceed the fees paid by the client for the specific service giving rise to the claim.
